1. Acknowledgement. This Agreement is between you and Swap-a-Doodle only, and not Apple, Inc. Swap-a-Doodle, not Apple, is solely responsible for the Swap-a-Doodle iOS App and its content.
2. Scope of License. Swap-a-Doodle grants you a limited, non-transferable, revocable license to use the Swap-a-Doodle iOS App for your personal, non-commercial purposes. You may only use the Swap-a-Doodle iOS Apps on an Apple iOS device that you own or control and as permitted by the Apple App Store Terms of Service.
3. Maintenance and Suppport. Swap-a-Doodle does not guarantee any maintenance or support for the Swap-a-Doodle iOS App. To the extent that any maintenance or support is required by applicable law, Swap-a-Doodle, not Apple, shall be obligated to furnish any such maintenance or support.
4. Warranty. The Swap-a-Doodle iOS App is provided on an "as is" basis. Swap-a-Doodle disclaims all warranties about the Swap-a-Doodle iOS App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, Swap-a-Doodle, not Apple, shall be solely responsible for such warranty.
5. Product Claims. Swap-a-Doodle, not Apple, shall be responsible for any claims relating to the Swap-a-Doodle App or your possession and/or use of that App, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual Property Rights. In the event of any third party claim that the Swap-a-Doodle App or your possession and use of that App infringes that third party's intellectual property rights, Swap-a-Doodle, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim, to the extent required by law.
7. Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement. You must comply with applicable third party terms of agreement (e.g., your wireless data service agreement) when using the Swap-a-Doodle App.
10. Third Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this agreement, and that, upon your acceptance of the terms and conditions of this agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third party beneficiary thereof.
11. Terms of Service. The Swap-a-Doodle online service ("the service") is provided by Swap-a-Doodle under the Terms of Service available on the website and in the App. You acknowledge and agree to these terms of service.
